unika Health, Inc. ("unika," "we," "our," "us") commits to protecting privacy through compliance with this policy. This Privacy Policy explains practices regarding information collection, use, maintenance, protection and disclosure connected to the website, the unika Unified Care application (the "Application"), devices, products, services, portals, and related materials and technologies (collectively the "Services").

Important Note: unika is not a medical group. Telemedicine consults through the website, application, or services come from independent medical practitioners (each a "Provider"). The Provider supplies you with a Notice of Privacy Practices describing health information collection and use, not unika. If you disagree with those terms, you cannot access or use the website, application, or services and must exit immediately. In the event of a conflict between this privacy policy and the notice of privacy practices, the notice prevails.

This policy applies to information collected on the Website and Application, through Services, and through various electronic communications when interactions involve advertising that links to this policy.

The policy does not apply to information collected through other means, other websites operated by unika, or by third parties.

2. Children Under the Age of 18

unika does not knowingly collect personal information from children under 18 without parental or legal guardian consent. Users under 18 must have their parent or legal guardian create the account and agree to the Terms of Use and Privacy Policy on their behalf. Users under 13 may only use Services with parental or legal guardian supervision and consent, including Provider consultations.

The Application collects real-time device location information. Declining collection means not downloading the Application or deleting it.

Hotjar

The Website uses Hotjar's third-party services, which records user activities to understand user experience. Hotjar records your interaction with our website through your keyboard strokes, mouse movements and activities to show how users interact with different features and elements.

4. How We Use Your Information

unika uses collected information for purposes including: providing and administering services, presenting website and application content, processing transactions, sending account notices, administering surveys, enforcing contracts, and contacting users about products and services.

We may also use your information to contact you about devices, products and Services that may be of interest to you, including through newsletters.

HIPAA Protection: Protected Health Information (PHI) will not be used for any other purpose, including marketing, without your consent.

5. Use of AI

unika employs artificial intelligence tools following HHS guidelines. The organization uses AI to enhance customer service, support staff in assessing symptoms, and improve administrative efficiency.

Important: We do not use your data to train our AI/large language model (LLM). AI systems may provide inaccurate, incomplete, or misleading information. Users can opt out of AI interactions at any time. unika will not hold liability for damages from AI use.

6. Disclosure of Your Information

unika shares information with providers, facilities, affiliates, contractors, service providers, and potential business successors. The organization also discloses data to comply with any court order, law, or legal process, including to respond to any government or regulatory request.

7. Choices About How We Use and Disclose Your Information

Users can control cookie settings through browser preferences and opt out of promotional emails by clicking unsubscribe links in communications.

8. Your Rights Regarding Your Information and Accessing and Correcting Your Information

You can review and change your Personal Data by logging into our Website or Application and visiting the profile page. You may also notify us through the Contact Information below of any changes or errors in any Personal Data we have about you to ensure that it is complete, accurate, and as current as possible or to delete your account. We cannot delete your personal information except by also deleting your account with us. We may also not be able to accommodate your request if we believe it would violate any law or legal requirement or cause the information to be incorrect.

With respect to any PHI unika may obtain, you have certain rights under HIPAA to access your data, to restrict use and disclosure of it, to request communication methods, to request corrections to your data, to receive an accounting of disclosures and to receive notice of any breach.

9. Do Not Track Signals

Some web browsers permit you to broadcast a signal to websites and online services indicating a preference that they "do not track" your online activities. At this time, we do not honor such signals, but we currently do not use automated data collection technologies to collect information about your online activities over time and across third-party websites or other online services (behavioral advertising).

The organization has implemented protective measures to safeguard personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. We utilize encryption technology for information sent and received.

Privacy Addendum for California Residents

This Privacy Addendum for California Residents ("Privacy Addendum") supplements the information contained in the unika Privacy Policy and applies solely to all visitors, users, and others who reside in the State of California ("consumers" or "you"). We adopt this notice to comply with the California Consumer Privacy Act of 2018 ("CCPA"), as amended, and any terms defined in the CCPA have the same meaning when used in this notice.

Personal Information that is regulated under the CCPA may represent a limited portion of Personal Data as described in the unika Privacy Policy; therefore, this Privacy Addendum applies solely to the Personal Information as defined below. We may update this Privacy Addendum as necessary and in the event of changes in the CCPA. Note that this notice does not apply to our personnel.
